AIRspirit - Terms of Service

By accessing or using AIRspirit.com (the "Site"), you agree to these Terms and all applicable laws and regulations. If you do not agree, you must not use the Site.

AIRspirit is a technology and informational platform only.

AIRspirit is NOT:

• A certified flight planning system
• An operational flight dispatch service
• A provider of aeronautical information services (AIS)
• An air navigation service provider (ANSP)
• An air operator or broker
• A substitute for official aviation tools

The Site is not certified under any aviation authority including:

• Federal Aviation Administration (FAA)
• European Union Aviation Safety Agency (EASA)

ALL INFORMATION PROVIDED BY AIRSPIRIT, INCLUDING THE "FLIGHT ANALYSIS" FEATURE, IS:

• NOT VALID FOR FLIGHT PLANNING
• NOT VALID FOR NAVIGATION
• NOT VALID FOR OPERATIONAL DECISION-MAKING
• NOT VALID FOR SAFETY-CRITICAL USE

⚠️ PILOT IN COMMAND RESPONSIBILITY

Under applicable aviation regulations, including but not limited to:

• 14 CFR §91.3
• EASA Air Operations Regulation

👉 The Pilot in Command (PIC) has full and final authority and responsibility for the safety of the flight.

You expressly acknowledge that:

• Only certified pilots and operators may make flight decisions
• AIRspirit provides no operational oversight
• Any use of the Site in a real aviation context is entirely at your own risk

⚠️ MANDATORY USE OF OFFICIAL SOURCES

You MUST rely exclusively on official, certified aviation sources, including but not limited to:

• Approved flight planning systems
• Certified weather briefings
• Official NOTAM databases
• Air Traffic Control (ATC) instructions

AIRspirit must never be used as a primary or secondary source for these purposes.

The Flight Analysis feature:

• Is powered by AI systems
• May produce incorrect, incomplete, or misleading outputs
• Does not account for real-time operational constraints
• Does not guarantee terrain clearance, obstacle avoidance, or safety margins

Explicit limitations:

Flight Analysis does NOT:

• Validate route safety
• Guarantee obstacle clearance
• Replace terrain awareness systems (TAWS/EGPWS)
• Replace pilot training or judgment

👉 It is a conceptual and educational tool only.

You agree that:

• You will not rely on AIRspirit for any aviation-related decision
• You will not use the Site in-flight or in pre-flight operational planning
• You assume full responsibility for any consequences of use

AIRspirit may aggregate data from third parties.

Such data:

• May be delayed, inaccurate, or incomplete
• May be subject to outages or errors
• Is not verified or certified by AIRspirit

AIRspirit has no obligation to validate or correct such data.

To the maximum extent permitted by law:

AIRspirit shall not be liable under any circumstances, including negligence, for:

• Aviation incidents or accidents
• Loss of life, injury, or damage
• Flight deviations or operational errors
• Any decision made based on the Site
• Any indirect, incidental, or consequential damages

This applies even if AIRspirit has been advised of potential risks.

You agree to fully indemnify and hold harmless AIRspirit from:

• Any aviation-related claim
• Any misuse of the Site
• Any reliance on AI-generated outputs
• Any regulatory or legal consequences arising from your actions

You acknowledge that AI:

• Does not perceive reality
• Does not have situational awareness
• Cannot assess real-time safety risks

AI outputs are:

• Probabilistic
• Non-deterministic
• Potentially erroneous

All content, including AI systems, data structure, and platform design, is owned by AIRspirit. Unauthorized use is strictly prohibited.

AIRspirit complies with:

• General Data Protection Regulation
• California Consumer Privacy Act

Users may exercise their rights under applicable law.

AIRspirit may:

• Interrupt or discontinue services
• Modify or remove features (including Flight Analysis)
• At any time without notice

AIRspirit is not subject to certification requirements applicable to:

• Flight dispatch systems
• Navigation systems
• Safety-critical avionics

The Site must be considered non-certified consumer software.

Primary jurisdiction: Switzerland.

Mandatory consumer protections may apply depending on user location (EU / US).

If any provision is invalid, the remainder remains enforceable.
